Creditors Remedies & Collections
Do you owe money or are you owed money? Debt collection is an unpleasant reality for many businesses. When debtors default, businesses need a qualified corporate debt collection and breach of contract lawyer to help them secure their money in a timely manner. I can help. Call me today for a free consultation.
Moreover, did you know that bill collectors in Canada often use aggressive tactics to chase consumers, sometimes even managing to reel in payments when no credit was owed in the first place? Some practices, such as daily phone calls, threatening language, accosting friends and relatives, or contacting debtors during late-night or early-morning hours, amount to illegal behaviour, depending on the province or territory. If this is happening to you, I can help. Please call me today for a free consultation.
Bankruptcy & Insolvency
Bankruptcy is a process governed by the Bankruptcy and Insolvency Act (BIA). Any insolvent person who has no other way to meet his or her financial obligations may file for bankruptcy, unless they have not been discharged from a previous bankruptcy. In a bankruptcy, people or companies (“debtor”) who can no longer pay their debts give all of their non-exempt property to a trustee in bankruptcy who then sells it and distributes the money to creditors. Bankruptcy can be voluntary or forced by a creditor through the Courts.
Roughly 90 percent of bankruptcies in Canada are consumer bankruptcies where the business-related debts make up less than 50 percent of the bankrupt’s total debts. When the bankrupt’s realizable assets do not exceed $15,000, the bankruptcy is processed under summary administration. Almost all consumer bankruptcies are processed this way. Securities Law
From listing companies on public exchanges in London (LSE and LSE AIM), New York (NYSE), Toronto (TSX and TSX-V), and providing in-house litigation counsel, I have advised and represented company and shareholder interests involving “pump and dump” and “short and distort” securities fraud and white-collar crime. I take cases dealing with bankers, brokers, firms and investment firms and am interested in all forms of proceedings arising in the field of securities law and regulation, both federal and provincial.
Because of my unique understanding of international corporate finance transactions, hedge fund formations, alternative investment vehicle structuring and capital markets experience gained from working in London with leading US law firms, I was hired by Silvercorp to assist management, the board of directors and external legal counsel with “short-and-distort” litigation and a high-profile corporate securities fraud and defamation investigation. Responsible for managing and overseeing litigation in Vancouver, New York, Seattle, Australia, Hong Kong, China and all legal matters pertaining to the related regulatory and law enforcement investigations.
During my time with Silvercorp Metals Inc., I liaised routinely with the BCSC, IIROC, RCMP, HK Police Force, HKSFC, the FBI and SEC. Duties included frequent travel to New York for depositions with external counsel (K&L Gates LLP), NYSE court appearances, meetings with data forensics experts (including John Reed Stark, Managing Director of StrozFriedberg LLC) and other company-retained consultants, including KPMG Forensics Inc.
